Despite the obvious illogical nature of this post's title, The Messiah has announced that there might be prosecutions in the future for the lawyers who issued the legal opinions on the "enhanced interrogation techniques." He is obviously not going to go after the soldiers who participated. An American soldier not only has the responsibility, but the duty to refuse to carry out illegal orders. Once the soldiers were presented with the legal opinions, OPINIONS mind you, the soldiers were obligated to carry out their orders. Besides, to the liberal mindset, soldiers are little better than servants, and exist to do as they are told by their betters.
I know very little about how the C.I.A. operates, but if they operate like the military, than the same rules apply. If the C.I.A. operates under civilian law than the situation becomes a little murky. What about the previous administration? Can't do that because the chosen one does not have the guts to fly in the face of over 200 years of tradition that says that an incoming administration does not attack they outgoing administration. While the comrade chairman will attack anyone and anything, including his own nation. with words, he just doesn't have it in him to initiate the fight and bad press involved in prosecuting anyone who can steal his media spotlight. So who is left? The lawyers.
Now generally I am for anything that reduces the members of that peculiar anti-social race, but what would be the basis for the indictment? Opining while stupid? Seems the natural state sort of thing. Leaving aside the issue of whether or not water-boarding is torture, or if the threat posed by the terrorist justified water-boarding. Since when did issuing a legal opinion become an indictable offense? If issuing an incorrect opinion is a crime, we should indict the judges that upheld the illegal D.C. gun ban before S.C.O.T.U.S. overturned it. How about we indict Billy Clinton for not ordering the cruise missile strike on Osama bin Laden when we had him in our sights. Hell, go back and indict everyone. We could get Lincoln for suspending habeas corpus, J.Edger Hoover for illegal wiretaps and F.D.R. and Truman for the slaughter of innocents during WWII.
Obama will find this a hard row to hoe. How about Pelosi's witch hunts? She is gonna be awfully embarrassed when her constituents find out that she knew about the water-boarding for months without a peep, then suddenly when the story breaks she is so heart broken and ashamed. Just keep in mind that prosecuting lawyers for legal opinions is an awfully slippery slope. Now if they fabricated it knowingly at the desire of there political masters, then I say let the roast begin.
